I. Introduction

The warranty information set out in this Enterprise Product Warranty Policy (“Warranty Policy”) reflects H3C’s general warranty policies. H3C enterprise hardware products are generally covered by a one (1)-year warranty. Certain products are eligible for an extended warranty of up to five (5) years. H3C software products are covered by a ninety (90)-day warranty. For detailed information on the warranty applicable to specific products, please refer to the Enterprise Product Limited Warranties.

All H3C warranties extend only to the Original End User Customer (the individual or entity that purchased the product for its own use, collectively referred to in this Warranty Policy as the “Customer”) in the countries or regions where the products are purchased; and are non-transferable. The warranty shall be provided by H3C or an H3C-authorized Channel Partner (collectively referred to in this Warranty Policy as “H3C”). H3C warranties are subject to, and provided only on the terms and conditions of this Warranty Policy. Unless expressly provided otherwise herein, in the event of any conflict between this Warranty Policy and the contract terms and conditions, the contract terms and conditions shall prevail.

II. General terms and conditions

“Starting Date” as used in this Warranty Policy means the earlier of: (i) the date the product is delivered from the manufacturing site of H3C Technologies Co., Ltd. to the Customer, or (ii) in the case of resale by an authorized reseller of H3C to the Customer, the ninetieth (90th) day after the original delivery date of the product by H3C Technologies Co., Ltd.

H3C warrants its software and hardware products for the applicable warranty period commencing on the Starting Date.

1. The warranty period for software is ninety (90) days. If, during the warranty period, the software fails to conform to the functional standards set out in the product instructions, or the software media is found to have defects in materials or workmanship under normal authorized use consistent with the product instructions, H3C will, at no charge, replace the media or correct the defect. For any defect, H3C may, at its sole discretion, provide software patches, replace the software with an upgraded version or refund the purchase price of the software.

2. The warranty period for CT hardware products is one (1) year, although certain products will be eligible for an extended warranty of up to five (5) years. The warranty period for IT hardware products is three (3) years. If the hardware is found to have defects in materials or workmanship under normal authorized use consistent with the product instructions during the warranty period, H3C will, at its sole discretion, repair or replace the defective hardware. Replacement hardware may consist of new or refurbished equipment of the same type, function and quality. Any defective hardware that is replaced shall be the property of H3C. H3C will use commercially reasonable efforts to ship replacement hardware upon receipt of the defective hardware. Shipment of spare parts will be initiated upon approval of the Return Material Authorization (RMA) application. Actual delivery times may vary depending on the Customer’s location.

The warranty period for the product will not be affected by any resale or repair. However, the warranty period for any replacement or repaired unit shall be the longer of (i) three (3) months commencing from the date the replacement or repaired unit is delivered by H3C to the Customer, or (ii) the remainder of the original warranty period.

H3C reserves the right to inspect any replaced or returned product or unit. If a replaced or returned product or unit is found to be free of defects or damaged due to misuse by the Customer, H3C may charge the Customer for all associated costs, including testing, handling, and reshipping.

The Customer shall submit a formal service request to H3C within ten (10) business days upon detection of any defect. Service requests for multiple failed units that have accumulated over time and submitted collectively after the expiration of the aforementioned ten (10)-business-day period shall be deemed as backlogged service requests. H3C will use commercially reasonable efforts to provide support for backlogged service requests. However, due to factors such as concentrated fault volumes, spare parts allocation and service resource scheduling, H3C does not guarantee compliance with the applicable Service Level Agreement (SLA) response and delivery timelines for such requests.

3. H3C IT Options are covered by a three (3) year, parts-only limited warranty. The Customer shall return any defective H3C Option to H3C at the Customer’s own cost. H3C will provide replacement parts support, however, onsite service support is not provided. If the Customer requires on-site service support, additional labor, logistics and related service charges will apply. If an H3C Option is installed in an H3C hardware product, the warranty service level applicable to the Option shall be the same as that applicable to the host hardware. The applicable warranty coverage period shall be the longer of (i) the warranty period originally provided for the H3C Option; and (ii) the remaining warranty period of the H3C hardware product in which the Option is installed.

If the remaining warranty period of an H3C Option exceeds the warranty period of the H3C hardware product in which it is installed, a parts-only warranty shall apply during such remaining period. This warranty does not cover any damages, malfunctions, or non-conformities caused by the use of any storage devices (including HDDs, SSDs, and SD cards) that have exceeded their rated write endurance limits.

4. Dead On Arrival (DOA). The DOA start date shall be the date on which the equipment is first powered on, provided that the period between the first power-on date and the warehouse shipment date of H3C Technologies Co., Ltd. does not exceed ninety (90) days. If, within thirty (30) days from the DOA start date, the hardware is found to have no physical damage upon unpacking but fails to operate substantially in accordance with product specifications within forty-eight (48) hours following initial installation and first power-on, H3C shall provide an expedited DOA replacement. “Fail to operate” means a material failure to substantially perform in accordance with the hardware's technical specifications (excluding exterior nicks or other deficiencies that do not materially affect hardware performance). Upon verification of a DOA claim, H3C will ship a new replacement unit or part within seven (7) business days following H3C's confirmation of the DOA failure via a commercially reasonable solution. The defective hardware must be returned to H3C within fifteen (15) business days after the Customer receives the replacement unit or part, otherwise the Customer shall purchase the replacement hardware at H3C's then-current price. Actual delivery times are subject to variation based on the Customer's location and transportation conditions.

III. Limited Lifetime Warranty

Limited Lifetime Warranty is only available for specified products and in specified countries or regions.

HARDWARE LIMITED LIFETIME WARRANTY DURATION: Limited Lifetime Warranty applies for as long as the original Customer continues to own or use the product during the product life cycle. The Limited Lifetime Warranty support will terminate on the End of Service (EOS) date of the product.

Notwithstanding the foregoing, for designated WLAN AP and box switch products, H3C provides a hardware Limited Lifetime Warranty for a period of no more than five (5) years, even if such products have not reached their End of Life.

H3C will use commercially reasonable efforts to ship a replacement part within ten (10) business days after confirming the RMA request. Actual delivery times may vary depending on the Customer’s location.

IV. Limitation of Liability

(i) No warranty will apply if the hardware or software: (a) has been repaired, modified, or replaced without H3C's permission; (b) has not been installed, operated, or maintained in accordance with the instructions provided by H3C in the product documentation; (c) has been subject to unreasonable physical stress, contamination, fire, lightning, flood, misuse, abuse, accident or disaster; (d) has failed due to non-compliance with the requirements of environmental conditions necessary for normal operation of the products, including power supply, temperature, humidity, load-bearing, degaussing, pollution, or other external causes; (e) is licensed for beta, testing, training, evaluation or demonstration purposes.

(ii) The Customer shall be solely responsible for backing up all data and permanently deleting any confidential, proprietary or personal information from the defective product before returning it to H3C. H3C may perform a factory reset and storage formatting during repair, and all data will be permanently and irreversibly erased. H3C shall not be liable for any data loss, corruption or disclosure resulting from the Customer’s failure to back up or delete such data.

(iii) H3C’s warranty does not include installation support.

(iv) H3C’s warranty does not cover accessories, consumables, or non-electronic parts, including but not limited to: user manuals, power cords, cables, relay interface transfer boxes, cabinet structural parts, brackets, handle bars, slide rails, chassis, and similar items.

(v) H3C’s warranty applies only to H3C-branded products. Independent interface devices of Voice & Video Products, such as microphones, cameras, and similar accessories, will be covered solely by the warranty provided by their respective original manufacturers or suppliers.

(vi) No warranty shall apply to any product that has been repaired, modified or altered by any unauthorized third party, or from which any identification label, serial number or other product identification marking has been removed, altered or rendered illegible.

(vii) No warranty shall apply where the product is sold, supplied, exported, re-exported, or otherwise transferred to any country or region that is subject to international sanctions or export control restrictions, including but not limited to Cuba, Syria, North Korea and Iran.

Nothing in this Warranty Policy shall exclude or limit liability for personal injury to the extent such exclusion or limitation is prohibited by applicable law.

V. Disclaimer

(i) Except as expressly set forth in this Warranty Policy, H3C makes no representations or warranties of any kind, whether express, implied or statutory, including but not limited to, any implied warranties of merchantability, fitness for a particular purpose, title or non-infringement, or any warranties or obligations arising from a course of dealing, usage or trade practice.

(ii) H3C does not warrant that any software or firmware provided under this Warranty Policy will be error-free, uninterrupted, or free from all defects, nor does H3C warrant that it will be able to correct every software error. The operation of software may be affected by factors outside H3C’s reasonable control (including the network environment, third-party software, configuration, and the Customer’s systems).

VI. Compensation

In no event shall H3C, its affiliates, or its suppliers be liable for any loss of Customer data due to product failure or service interruption, or for any consequential, incidental, indirect or economic loss. To the maximum extent permitted by applicable law, and notwithstanding anything to the contrary in any contract, H3C’s total aggregate liability for all claims related to a single device shall not exceed the original purchase price paid by the Customer for such device.

This Warranty Policy applies to H3C products shipped on or after its effective date. To the extent permitted by applicable law, H3C Technologies Co., Ltd. reserves the right to interpret this Warranty Policy, and to update this Warranty Policy as well as product performance specifications without prior notice.

This warranty policy shall take effect on the date of publication and shall supersede all previously issued warranty policies.
